PLEASE READ OUR PRIVACY POLICY CAREFULLY BEFORE USING OUR PRODUCTS, OUR SERVICES, OUR WEBSITE, OUR MOBILE APPLICATION, OR OTHERWISE INTERACTING WITH JONA’S PLATFORM. YOUR USE OF THE PLATFORM IS GOVERNED BY OUR TERMS WHICH INCLUDE THIS PRIVACY POLICY.
For any information that is subject to a business associate agreement between you and Jona including the BA Terms, the terms of such business associate agreement or the BA Terms, as applicable, shall govern over the terms of this Privacy Policy.
Jona, Inc. (“Jona”, “we”, “our”, or “us”) understands the responsibilities of protecting your privacy and protecting your personal information. Jona’s Privacy Policy (“Privacy Policy”) describes how we collect, use, and share information about you when you use or otherwise interact with Jona’s websites, applications, online services, microbiome service, software, SaaS and PaaS services, other products and services, and certain third-party apps or services (collectively the “Platform”), including communications with us via email, text, or other electronic messages, and written documents, phone calls, and other offline activities between you and Jona.

1. Changes to this Privacy Policy. Jona may change, modify, or update this Privacy Policy from time to time, at our sole discretion. When the terms of this Privacy Policy have been materially updated we will update the “Last Updated” date above and update our Platform to reflect the updated Privacy Policy. By continuing to use the Platform after the Privacy Policy has changed you agree to all changes made by Jona to this Privacy Policy and that Jona posting the updated Privacy Policy on our Platform constitutes sufficient notice to you of such changes.
2. International Users, Use Outside the US. The Platform is intended solely for users in the United States. Individuals outside of the United States should not use the Platform. If you use the Platform or contact us from outside of the United
States, you are advised and you agree that any information related to your use of our Platform may be transferred, processed, or maintained outside your country in the United States and you expressly authorize its transfer and subsequent processing in the United States in accordance with this Privacy Policy.
3. Privacy of Minors. Our Platform is only intended for users 18 years of age and older. If you are under the age of eighteen (18), please do not attempt to use the Platform or provide any personal information about yourself to us. Our Platform does not solicit or knowingly collect personal information of users who are under 18 years of age and if we become aware of any such information being collected, we will take immediate action to delete it. 4. How We Collect Your Personal Information.
4.1. Information You Provide to Us. We collect information you provide to us when you create or modify your account, register to use our Platform, purchase products or services from us, post comments or reviews on our Platform, request information from us, contact customer support, or otherwise communicate with us.
4.2. Information We Obtain Indirectly. We may receive certain information about you through third-parties that provide us with such information as part of their relationship with us, including Google Analytics, Shopify, PayPal, Mixpanel, and other third-party tools. We may also receive information about you from your Google account if you use your Gmail account to sign-in to your account with us. The services provided by these third-parties are governed by their own privacy policies found on their associated websites.
4.3. Information We Collect Automatically. When you use our Platform, we collect certain information about you automatically through our use of cookies and similar technologies. We do not honor Do Not Track requests from your web browser or other mechanisms.
4.4. Cookies. We and our third-party service providers (e.g., sub-contractors, analytics providers, CLIA certified lab partner, etc.) may use cookies, web
beacons, and other technologies to receive and store certain types of information whenever you interact with our Platform through your computer or mobile device. A “cookie” is a small file or piece of data sent from a website and stored on the hard drive of your computer or mobile device. Some of the cookies we use are “session” cookies meaning that they are automatically deleted from your hard drive after you close your browser at the end of your session. Session cookies are used to optimize performance of the Platform and to limit the amount of redundant data that is downloaded during a single session. We also may use “persistent” cookies, which remain on your computer or device unless deleted by you (or by your browser settings). We may use persistent cookies for various purposes, such as statistical analysis of performance to ensure the ongoing quality of our Platform. On your computer, you may refuse to accept browser cookies by activating the appropriate setting on your browser, and you may have similar capabilities on your mobile device in the preferences for your operating system or browser. However, if you select this setting you may be unable to access or use certain parts of our Platform. Unless you have adjusted your browser or operating system setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Platform.
5. Personal Information We Collect and Use of Your Personal Information.
5.1. Information We Collect. Jona only collects and processes the minimum amount of personal information from you that is necessary for our information processing activities, which includes the following categories of personal information:
5.1.1. Contact information, including your name, mailing address, phone number, and email address;
5.1.2. Authentication information, including the user name and hashed password that you use to register an account on the Platform;
5.1.3. Financial information via our third-party payment processors - which may include your debit or credit card number, its expiration date, and its security code for payment processing purposes;
5.1.4. Personal information, including date of birth, general medical history, height/weight, and other medical or health information;
5.1.5. Comments, reviews, and suggestions you make about the Platform;
5.1.6. Online behavior information including details of your visits to our Platform, online activity, time spent viewing features, traffic data, location data, logs, language, date and time of access, frequency, and other communication data and the resources that you access and use on the Platform; and
5.1.7. Operating system, host domain, browser type, IP address, mobile network information, or device information.
5.2. How We Use Your Information. We may use your information for the following activities:
5.2.1. Conducting our business; customer communications and support; user verification; payment processing; shipping; quality management services;
5.2.2. Platform maintenance and improvements; designing, developing, our features, products, and services; communicating with you about our features, products, services; and communicating with you for commercial, or marketing purposes;
5.2.3. Any purpose where you have given your consent (including where legally required);
5.2.4. Enforcing our legal rights or subject to any consents or authorizations that are required by applicable law, including those of our subsidiaries, affiliates, etc. and any of their related businesses and those of our third-party partners; and
5.2.5. Complying with legal requirements or the law.
5.3. Aggregate Information. We may combine information we receive from other sources with information you give to us and information we collect about you. Depending on the types of information received, we will use the
information received from other sources or the combined information for the purposes described in this Privacy Policy. We may use deidentified or aggregated data about you for certain research purposes, business operations, product enhancement, or product development, and may share it with business partners.
6. Disclosure of Your Personal Information. Jona does not trade, rent, or sell your identifiable personal information to third parties. We may share or disclose de-identified information for any purpose without restriction. We may share or disclose your personal information for the following limited purposes:
6.1. Healthcare Providers. We may share your personal information with healthcare providers who provide your information to us on your behalf or who you authorize us to share information with. Information shared by or with healthcare providers may be subject to the BA Terms or another business associate agreement, in the event of a conflict between this Privacy Policy and an applicable business associate agreement, including the BA Terms, the terms of such business associate agreement shall control.
6.2. Vendors and Service Providers. We may provide information to third-party vendors and service providers that perform services and functions on our behalf, such as to help us operate and manage our Platform, including processing orders, fulfilling and delivering products and services that you purchase from us. These vendors and service providers may have access to your personal information in order to provide these services to us, but when this occurs, we implement contractual protections to limit their use of that information to help us provide products and services through our Platform and support our interactions with you.
6.3. Consent to Share Your Personal Information. We may also share personal information with companies, organizations, or individuals outside of Jona when we have your consent to do so. At no time will any identifiable personal information about you be shared with our business partners for research or commercial purposes without your express written consent. Where applicable, if Jona intends to further process your personal information for any other purpose not described in this Privacy
Policy, we will provide you with any relevant information on such additional purpose and obtain your consent, to the extent required by applicable law.
6.4. Legal Disclosures. We will share personal information with third-party companies, organizations, or individuals outside of Jona:
6.4.1. When we believe in good faith that access, use, or disclosure of the information is reasonably necessary to comply with a legal obligation;
6.4.2. When we believe in good faith that the law requires it;
6.4.3. At the request of governmental authorities conducting an investigation;
6.4.4. To verify or enforce our agreements, terms of use, or other applicable policies; or
6.4.5. Otherwise to protect the rights, property, safety, or security of Jona, third-parties, visitors to our Platform, or the public, as required or permitted by law.
6.5. Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes, or if we otherwise transfer assets relating to our business or the Platform to a third party, such as by merger, acquisition, bankruptcy proceeding, or otherwise, we may transfer personal information to the new owner. In such a case, unless prohibited by applicable law, your information would remain subject to the Privacy Policy applicable at the time of such transfer, unless you discontinue use of our Platform. We will inform you of any such changes in ownership.
7. Security of your Information.
7.1. Security Implementations. We have taken steps and implemented safeguards designed to protect against the risk of accidental, intentional, unlawful, or unauthorized access, alteration, destruction, disclosure, or use. The Internet is not 100% secure and we cannot guarantee the security of information transmitted through the Internet, which includes
email communications. We cannot guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your personal information.
7.2. Security of Your Account. We use best practices and industry standard security measures and tools to protect your data and verify security practices before engaging with third parties. Any transmission of personal information by you is at your own risk. Where you have been given or you have chosen a password, it is your responsibility to keep this password confidential. We are not responsible for the circumvention of any privacy settings or security measures contained on our Platform, in your operating system, or mobile device.
7.3. Third-Party Account Sign On. To the extent that you choose to use a third-party account or application (such as Google) to create your online account on the Platform or otherwise sign into the Platform, you understand that if another person has access to your third-party account, they will also have access to your account on the Platform. This means that the other person could access any of your personal information contained on the Platform. It is your decision whether to give another person access to your third-party personal accounts and whether to use that account to sign on to the Platform. Also, if you use a third-party account or application to sign into the Platform, you understand that the account or application may send information from your account to Jona.
